"Brother and sister Jonathan and Sarah were each left a half share of their fathers house and share portfolio. They were executors of the will and decided that Sarah would take the house and Jonathan the shares.
- Distribution was not according to the will
- Stamp duty was payable by Sarah on the half share of the house transferred to her by Jonathan."
- Andrew wanted to build his retirement home on the beach at Hawke's Nest where he bought a block some years ago.
- He died before he could do this.
- In his will he left everything to his wife Julia.
- Julia never shared Andrew's dream, however their 2 children did.
Julia decided to give the children the block as it was now assessed against her pension entitlements.
- Unfortunately the 'gift' of the land attracted stamp duty of $4,337 as it was treated as a transfer from Julia to the children.
